Jessica Wrye, RDN, CDCES, owner of As You Are Nutrition, (“Company,” “I,” “Me,” or “My”) respects your privacy and is committed to protecting it through the terms of this Privacy Policy.This Privacy Policy governs your access to and use of asyouarenutrition.com, including any content, functionality and services offered on or through the Website and any social media accounts related to the Website (collectively the “Website”). This Privacy Policy explains how your personally identifiable information is collected, used and disclosed. California law defines personally identifiable information to include names, physical and electronic addresses, phone numbers, social security numbers, and any other identifier that makes it possible to contact a specific individual in person or online. Please read the Privacy Policy carefully before you start to use the Website. By using the Website, you accept and agree to the terms of this Privacy Policy. If you do not consent to the collection, use, or disclosure of your personally identifiable information as outlined in this Privacy Policy, you should not use the Website.

How Your Information is Collected

As You Are Nutrition collects your personal identifiable information. Usually this information is provided directly from the client in the course of engaging dietary and nutrition services. For example, patients may provide their personally identifiable information to receive in-person or virtual nutrition counseling. I may also receive personally identifiable information directly from patients to develop specialized group classes or nutrition programs.

Personally identifiable information may also be collected through your use of the Website. For example, when you utilize the form on the contact page to get started on your health journey or to inquire about services. The personally identifiable information provided through my contact page includes your name, email address, phone number and any other personally identifiable information you include in the subject line or message sections of the form. If you register for a specialized group or class or sign up to receive my newsletter you will also be required to provide personally identifiable information. 

Other information collected through your use of the Website may include, without limitation, information about your browser, network and device; the web pages you visited prior to visiting the Website; and your IP address. This may include the details of how you use the Website such as which links are clicked on and which pages you visit.

I also collect personally identifiable information through social media platforms when you direct message or comment on any posts that are published by me.

How Your Information is Used 

Personally identifiable information collected through the Website is used for legitimate business purposes including providing client-related services and responding to requests submitted through the website contact form, social media accounts, or otherwise. Personally identifiable information is also used to present the Website and its contents to you.

I may use your personally identifiable information to send marketing materials such as announcements for specialized group and class registrations, notices regarding services or products, an informational newsletter, and any other information that I believe may be of interest to you.

Personally identifiable information may also be used to carry out obligations, to enforce rights pertaining to billing and collections, to improve the efficiency of services, and to ensure that I am compliant with legal and contractual requirements. This includes sending alerts for administrative information such as changes to policies and procedures.

However, the Website is hosted by the third-party service provider, SquareSpace, and I disclose the following information to SquareSpace to learn about site traffic and activity: information about your browser, network and device; the web pages you visited prior to visiting the Website; and your IP address. This may include, without limitation, the details of how you use the Website such as which links are clicked on and which pages you visit.

I may disclose your personal information to employees, student interns, and third-party service providers for the purpose of providing services to you. Third-party service providers may include billing service providers, scheduling service providers, and website host providers. I may also disclose your personal information to a third party, such as a lawyer or collection agency, when necessary to enforce the website Terms of Use or any other agreement between you and As You Are Nutrition or Jessica Wrye, RDN, CDCES, as owner of As You Are Nutrition. I may provide your information to a successor in interest in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets and/or business. I may disclose information when legally compelled to do so, in other words, when I, in good faith, believe that the law requires it or for the protection of my legal rights or when compelled by a court or other governmental entity to do so. 

I also disclose your personally identifiable information when working together with a multidisciplinary team of health care providers to provide medical nutrition therapy. This multidisciplinary team of health care providers includes the referring physicians or physicians responsible for the care of the patient in a licensed health care facility and registered nurses. Should you elect to post content to social media platforms, messaging systems, profile page, or the like, the information you disclose may become available to the general public.

How I Protect Your Information 

I employ commercially reasonable methods to ensure the security of the information you provide to me. This includes using standard security protocols and working only with reputable third-party vendors.

Email Communication 

Email is not recognized as a secure medium of communication. For this reason, I request that you do not send private information to me by email and doing so is at your own risk. 

Retention of Personally Identifiable Information

I retain personally identifiable information for the duration of client services, for any period as required by law, and where retention is advisable to protect my legal and business interests.

Options for Reviewing and Making Changes

Review and/or Request Changes to Personally Identifiable Information: If you would like to submit a request to review or change your personally identifiable information please email jessie@asyouarenutrition.com. Your request should be clear on the personally identifiable information you would like to review and/or change. I will respond to your request as required by law.

Marketing Communications: If you no longer wish to receive marketing communications you may unsubscribe by emailing jessie@asyouarenutrition.com. I will comply with your request within 30 days of receipt of your email.

Third Parties 

The Website is hosted by a third-party service provider, Squarespace, which collects your personally identifiable information when you visit the Website. The information Squarespace may collect includes, without limitation, information about your browser, network and device; the web pages you visited prior to visiting the Website; and your IP address. This collection, use and disclosure of your personally identifiable information is governed by SquareSpace’s and you are encouraged to review SquareSpace’s privacy policy.

I also use a third-party scheduler, SimplePractice, to schedule consultations and appointments. In order to schedule a consultation or appointment, you will be required to provide personally identifiable information to SimplePractice. Collection, use and disclosure of your personally identifiable information is governed by SimplePractice’s privacy policy. I do not collect, use or disclose this information and you are encouraged to review SimplePractice’s privacy policy.

I may also use the services of other third-party providers in addition to those providers already identified. This Privacy Policy does not cover the actions of any third-party service providers including, but not limited to, websites and social media accounts that the Website may link to. These third parties may have privacy policies that are substantially different than this Privacy Policy and may use tracking technology to collect personal information when you use my Website or navigate away from my Website.

These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use this Website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based advertising or other targeted content. 

I do not control these third parties and am not responsible for the policies or tracking technologies of third-party service providers or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the third-party service provider directly.

If I make material changes to how your personal information is collected, used, or disclosed, I will notify you by indicating the modification date at the top of this Privacy Policy. The link to this Privacy Policy will be maintained on the asyouarenutrition.com homepage.  You are responsible for periodically visiting this Website and this Privacy Policy to check for any changes.

Minors Under 18 Years of Age

California law prohibits the collection of personal data of minors that would be shared with third parties for the purpose of advertising or marketing certain types of products and services. 

The services provided by the Website are not intended for minors under the age of 18. The Website does not specifically market to minors under the age of 18 and I do not knowingly collect or use personal information from minors under the age of 18.
